This includes our platforms GoDalka and DalkaSchools. You may not reproduce, distribute, modify, create derivative works of, or publicly display any material from our services without prior written consent.

4. Data Ownership and Sovereignty

You retain ownership of all data you provide to us. We act as a data processor on your behalf and will not use your data for any purpose other than providing our contracted services. Data from our users — primarily based in East Africa — is processed and stored in compliance with applicable data protection laws. We will not transfer your data outside your jurisdiction without your explicit written consent.

5. Security Responsibilities

Dalka Tech Solutions LLC implements industry-standard security measures aligned with ISO 27001, SOC 2, and NIST Cybersecurity Framework — the same enterprise-grade standards we bring to our East African community platforms. You are also responsible for: maintaining the confidentiality of your account credentials; notifying us immediately of any unauthorized use; ensuring your use complies with applicable security requirements; and implementing appropriate access controls on your end.

6. Disclaimers

OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DALKA TECH SOLUTIONS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) OUR SERVICES.

8. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Minnesota, United States, without regard to its conflict of law provisions. Any disputes arising under these terms shall be resolved in the courts of Minnesota, USA. Users accessing our services from East Africa agree to these governing law provisions to the extent permitted by their local laws.

9. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms of Service. Upon termination, your right to use our services will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive.

10. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of significant changes by posting the new Terms on our website and updating the effective date. Your continued use of our services after any changes constitutes your acceptance of the new Terms.
